Qatar – Amendments to the Income Tax Law

An important news for tax aspects of Qatari dealings: Law (24) of 2018 has amended the Income Tax Law (21) of 2009 so that any provision of the former Law inconsistent with such amendments shall be repealed.

The new Law shall be complemented by a new Tax Regulation (to be issued, yet) depicting in clear-cut way many issues of the Income Tax Law and, above all, procedural aspects.

Also under the new Law, Qatar will be operating a “territorial” system of taxation whose features are still widely in line with former Law approach (see Scalia, Qatar and International Tax Law - Part II, in 11 Bull for Intl Taxn, 2015).

The new law provides for specific exclusion and exemptions.

Namely, a set of items of income is exempted, such as interest and bank returns for individuals, proceedings arising from Islamic Finance instruments, gross income arising from non-Qatari airlines operating in Qatar, gross income for some craft activities, gross income of Qatari individuals residing in Qatar, etc.

Principles to be fulfilled (unless granted a different method) and rules to be applied in calculating the taxable base, again, are roughly in line with pre-existing Income Tax Law with few remarkable differences when it comes, e.g., with deductibility of some costs.

In furtherance of the Qatari huge effort towards a full and continuous compliance with International standards, worth to underline that the new Law explicitly states that the application of the Law shall not prejudice any obligations imposed by international agreements or arrangements in the area of Exchange of Information.

Qatar – Establishment of the GTA

As part of the development process towards a more complete tax system, Qatar established a new General Tax Authority (the GTA).

The GTA is a separate entity, under the supervision of the Ministry of Finance, and will be in charge of the implementation of all tax laws. The GTA’s mandate includes:

• the implementation of all tax laws and setting up all related bylaws, procedures and instructions,

• reviewing and assessing tax return forms submitted by all establishments and the collection of taxes from subject entities,

• representing the State of Qatar in relevant international and regional organizations as well as in international conferences and events,

• signing agreements with other countries regarding the prevention of double taxation to encourage economic cooperation and joint investments.
